1. Activities Covered

This agreement applies to all Fortified Athlete programming, including group training, private one-on-one training, small group training, clinics, camps, free introductory sessions, evaluations, competitions, conditioning and strength work, and any related activity conducted or supervised by Fortified Athlete or its coaches. It remains in effect for as long as the athlete participates, and does not need to be re-signed each season.

2. Training Locations

I understand and agree that Fortified Athlete conducts training at multiple locations, including but not limited to:

·         1914 SW 17th Ct, Miami, FL 33145 (private residence)

·         St. Sophia Greek Orthodox Cathedral, 2401 SW 3rd Ave, Miami, FL 33129

·         The private residence and court of Coach Arian, address provided upon enrollment

·         Other private residences, courts, parks, gymnasiums, and facilities used by Fortified Athlete from time to time, including the homes of private clients

This agreement applies to every such location and to each property owner, host organization, and facility where training occurs, including their respective clergy, officers, directors, employees, volunteers, and agents.

Fortified Athlete is an independently operated program and is not affiliated with the Greek Orthodox Archdiocese or presented as an Orthodox ministry.

3. Assumption of Risk

I understand that basketball and athletic training involve inherent risks of injury, including but not limited to sprains, strains, fractures, dental and facial injuries, concussion and other head injuries, heat-related illness, permanent disability, and in rare circumstances death. I understand these risks cannot be eliminated regardless of the care taken by coaches. I further understand that training occurs outdoors and may involve heat, sun, humidity, insects, uneven or wet surfaces, and contact with other participants. Knowing these risks, I voluntarily allow my child to participate and I assume all such risks on my child's behalf and my own.

4. Release and Waiver of Liability

In consideration of my child being permitted to participate, I hereby release, waive, discharge, and covenant not to sue Basketball With Life LLC d/b/a Fortified Athlete, its owners, officers, members, coaches, employees, independent contractors, and volunteers, and each property owner and host organization identified in Section 2, including St. Sophia Greek Orthodox Cathedral and its clergy, officers, employees, and volunteers (collectively, the "Released Parties"), from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, illness, or injury, including death, sustained in connection with participation. This release does not apply to gross negligence or willful misconduct.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, they may incur arising out of my child's participation, and from any claim brought by or on behalf of my child.

6. Health Representation and Medical Authorization

I certify that my child is in good physical health and able to safely participate in vigorous athletic activity. I agree to disclose any medical condition, allergy, medication, or prior injury that may affect participation in the form below, and to notify Coach Nick promptly of any change. If my child is recovering from injury or surgery, I agree to provide written clearance from a physician before returning to training.

I authorize Fortified Athlete and its coaches to obtain or administer emergency medical care, including transport to a medical facility, if I cannot be reached. I accept full financial responsibility for any such care.

7. Photo, Video, and Media Release

I grant Fortified Athlete the irrevocable right and permission to photograph, film, and record my child, and to use, reproduce, edit, publish, and distribute those photographs, recordings, and my child's name, likeness, and voice for marketing, advertising, promotional, and educational purposes, in any media now known or later developed, including social media, websites, print, and paid advertising, worldwide and in perpetuity, without compensation, notice, or further approval. I waive any right to inspect or approve the finished materials. I understand that this permission is a condition of participation in Fortified Athlete programming.

8. Athlete Expectations

I agree that my child will:

·         Arrive early and prepared

·         Bring proper shoes, attire, and a full water jug

·         Be coachable, respectful, and focused

·         Commit to improving weekly

·         Train at home using the assigned tracker

·         Understand that their results are their own responsibility

9. Parent Expectations

I agree that I will:

·         Communicate with Fortified Athlete through WhatsApp

·         Support my child's consistency and effort

·         Refrain from coaching from the sidelines

·         Notify Coach Nick two weeks before my renewal date if I am making changes or cancelling

10. Automatic Renewal and Cancellation

All plans automatically renew, whether monthly, three month, six month, or twelve month. If I am continuing, no action is needed. If I am making changes or cancelling, I must notify Coach Nick at least two weeks before my renewal date. Notice given less than two weeks before the renewal date takes effect at the following renewal.

11. Missed Session Policy

If my child misses a session, that session is forfeited. Missed sessions are not refunded or credited. My child may attend another session within the same week at a location included in my plan, if space is available.

12. No Refund Policy

All sales are final. There are no refunds for training, camps, clinics, or events. This includes upfront payments and monthly payments.

13. Injury and Rainout Policy

Injuries happen and we will always do what is fair. For a minor injury, modified movement or rest is encouraged while remaining part of the program. In cases of severe injury requiring extended time off, the membership is paused until the athlete is medically cleared to return.

All of our courts are outdoor. Rainouts are determined by Coach Nick and communicated via WhatsApp. Weather calls are made per location, so a cancellation at one location does not mean a cancellation at another. A parent decision not to attend a session that has been deemed safe is considered a forfeited session.

14. Conduct and Removal

I understand that athletes are expected to follow the Fortified Athlete Culture Code and all coach instructions. Fortified Athlete reserves the right to remove any athlete from a session, or from the program, for conduct that is unsafe or disruptive to other athletes, without refund.

15. Governing Law and Venue

This agreement is governed by the laws of the State of Florida. Any dispute arising under it shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

16. Severability

If any provision of this agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Electronic Acceptance

I agree that submitting this form electronically constitutes my signature and has the same legal force and effect as a handwritten signature, consistent with the Florida Uniform Electronic Transaction Act. I confirm that I am the parent or legal guardian of the athlete named in this form and that I am at least 18 years of age.

I have read this agreement in full. I understand that it is a release of legal rights and a contract between me and the Released Parties. I agree to it freely and voluntarily.
