Basketball With Life LLC (Operating as Fortified Athlete) Terms and Conditions
Player and Parent Training Agreement
Step 1: Please read our terms and training agreement entirely to understand Basketball With Life LLC expectations. If you have any questions or concerns, text Coach Nick at (786) 342-3459 to schedule a phone call. Also, note that anything to do with Fortified Athlete directly connected to Basketball With Life LLC.
Step 2: Once you have reviewed this document, you simply agree to the terms by entering your full name, email, phone number, and signing on the form below and click the “I agree to the terms and conditions” box to submit your form.
*If you do not agree with our terms and player/parent expectations - we ask that you do NOT enroll into our program. Our terms are extremely clear and protect the integrity of our program. Our program is selective and certainly NOT for every family. We only want to work with families who truly buy into our culture at Basketball With Life LLC.
1. TERMS
This Agreement will begin on (the day you register) and continue until your plan is terminated or cancelled.
If you choose to cancel your plan, I agree to provide Coach Nick a 2 week notice to cancel any future recurring payment. If you do not follow our terms, you will be automatically enrolled into the same agreement for the following month (no exceptions).
By registering for the program, you agree to the “terms and conditions” below, the player expectations and the parent expectations that clearly states Coach Nick's refund, cancellation details, and early termination policy.
2. PLAYER EXPECTATIONS
I agree to be a positive player who is coachable.
I agree to work hard in every session, I’m here to develop and reach my goals as a player.
I agree to be accountable to Coach Nick's program and not make excuses.
I agree to bring a full water-jug and proper attire to each session.
I agree to be committed every week and dedicate time to work on my own away from our sessions.
I agree to put in the work needed to become a better player. My results are my responsibility.
I agree to be a positive player when I make mistakes at the sessions.
3. PARENT EXPECTATIONS
Once we become a member, all communication is done through our whats app group chat or online community on Skool.
We have a very clear no refund policy. All sales are final once you enroll into our program.
If you (as a parent) have questions during the week, you can ask questions inside of our whats app group chat 24/7 or DM me inside of the online community and will receive a response within 12 hours (Monday-Friday).
If practice is canceled. Coach Nick will notify the PLAYERS and PARENTS through the group chat and/or Online Community. Practice updates/cancellations are only communicated through the chat or online community.
I understand that if we are late to the session we will forfeit the time (all sessions last 45-70 minutes)
I agree with Coach Nick's Reschedule policy, meaning if you miss that session - we don’t offer a makeup session. However, since there are 4 total days of training available (weather permitting), there is flexibility for other days of the week to be used.
As a parent, if I have questions, I understand that I can ask questions anytime through the chat or online community.
I understand that during the sessions, I will not pressure my child or yell from the sidelines. We train in a “non-pressured” environment
I understand that Coach Nick will decide the “rain-out’s” or rescheduled sessions due to weather/covid. He will always check weather conditions before the sessions and will communicate via whats app or the online community if there is a cancellation.
I understand how to communicate with Coach Nick (and set up a 10 minute scheduled call if and when there are conflicts/vacations in advance) so we can better prepare for our sessions.
I understand that if we are “out of town” or “on holidays” that we are still a member of the program. Please communicate with Coach Nick when you are going out of town so we can plan accordingly.
I understand that Coach Nick's billing process is an automatic payment made every month.
I understand that if I have a “failed credit/debit card payment” I will need to register with a new credit or debit card within 12 hours of the failed payment. Sessions will pause until the payment is collected.
All sales are final. If you enroll and don’t use the sessions - there are no make-up sessions for missed sessions.
We offer a monthly plan. If you want to CANCEL your membership, please notify us 2 weeks or more BEFORE the end of our agreement. By doing so, we will cancel the account. If not, you are auto-renewed into the next training term automatically.
I understand Basketball With Life LLC, Fortified Athlete, Coach Nick, and any assistant coach is not liable for any injuries.
Our Terms and Conditions apply to any training program offered by Basketball With Life LLC including but not limited to, Fortified Athlete and Fortified Athlete Online Community. By scheduling any session, you are agreeing to the following terms and conditions of our company:
1. SOCIAL MEDIA RELEASE POLICY
“I, the undersigned, do hereby grant permission to Basketball With Life LLC to post my and/ or my child’s story, photo, videos, hereinafter referred to as “Materials,” taken by Basketball With Life LLC during sessions or that I submit to and for the Basketball With Life LLC website, Instagram, and Facebook accounts.
I hereby release you, your representative, employees, managers, members, officers, parent companies, subsidiaries, and directors, from all claims and demands arising out of or in connection with any use of said “Materials”, including, without limitation, all claims for invasion of privacy, infringement of my right of publicity, defamation and any other personal and/or property rights”.
2. HEALTH AND WELLNESS POLICY
“I have enrolled in the personalized health and fitness program offered through Basketball With Life LLC.
I recognize that the program may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities.
I hereby affirm that my child is in good physical condition and does not suffer from any known disability or condition which would prevent or limit my participation in this exercise program. I acknowledge my enrollment and participation in Basketball With Life LLC training.
“I fully understand that my child may injure themselves as a result of my enrollment and participation in this program and I hereby Release and Forever Discharge Basketball With Life LLC and its agents, employees, representatives, affiliates, successors, or assigns, from any and all liability now or in the future for any conditions, injuries, sickness, losses, expenses or damages that I may obtain or incur. These conditions may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other soreness that I may incur, including death.”
3. INJURY POLICY
If injury occurs and a player is unable to participate in the training sessions, the recurring payments will pause until further noticed.
4. MISSED SESSION POLICY
We maintain a zero-tolerance missed session policy. If a session is missed without prior notice, the session is forfeited. There are no make-up sessions for missed practices. However, there are 4 training days available per week, offering flexibility for participation.
5. RAINOUT POLICY
If there is significant rain during the morning or evening of our scheduled session, the session may be rescheduled upon Basketball With Life LLC staff decision. Basketball With Life LLC staff will check to ensure the court is safe before every session. If the court is playable, we will resume the session. Parents do not determine if the session is canceled. If a parent decides not to attend a session that has been deemed “playable”, then that session will count as a cancellation.
6. PAYMENT POLICY
Payment is captured through a third-party system. Monthly payments are charged automatically from the day the first payment is made. If your payment method fails, you are required to update your payment information within 12 hours. Failure to do so will result in the suspension of training until payment is received.
Late Payments: If payment is not resolved within 12 hours, you may lose access to sessions.
7. REFUND POLICY
Due to the demand for our programs, we do not offer refunds for ANY case for any program, including private training, small group training, camps, clinics or any program that is added to our Training Page.
Once a player reserves a training spot, we hold the spot for the player for the specific program.
8. EARLY TERMINATION POLICY
You can opt out of and cancel your contract anytime by providing written notice of intent to cancel to Basketball With Life LLC.
By becoming a customer of Basketball With Life LLC, I agree to the terms on this website. I have signed a contract stating that I have reviewed this page in depth and agree to Basketball With Life LLC Terms and Conditions.
9. ONLINE COMMUNITY PARTICIPATION
The Fortified Athlete Online Community is essential for your child's development. This is where you will find:
Homework Assignments: Weekly homework is mandatory and should take only 15-20 minutes to complete. This will reinforce both basketball skills and mental development.
Faith Development: The community includes resources for personal growth through faith-based courses, prayers, and faith journals.
Progress Tracking: The online community offers tools for tracking progress, setting goals, and completing assignments.
Incentives: Players can level up and earn rewards, such as free training sessions, gear, and special recognition, by engaging in the community, completing homework, and tracking their progress.
10. PLAYER REPORT CARDS AND ACCOUNTABILITY
As part of our commitment to your athlete’s development, Basketball With Life LLC provides regular Player Report Cards. These report cards will evaluate the athlete’s progress across several areas, including:
Results in Benchmarks: Speed, shooting accuracy, vertical jump, etc.
Overall Development: Skill enhancement, basketball IQ, teamwork, and leadership.
Homework Tracking: Whether they complete their assigned weekly homework.
Effort, Attention, and Discipline: Monitoring their participation in practices and attitude toward training.
Accountability and Responsibility: Demonstrating ownership of their growth and following through with tasks.
These report cards are designed to keep athletes accountable and ensure their steady progress. Regular evaluations help both athletes and parents stay informed on their performance, highlighting areas of strength and identifying areas for improvement.
11. HOMEWORK ACCOUNTABILITY SYSTEM
At Fortified Athlete, homework assignments are mandatory and form a key part of our accountability system. These assignments are designed to be easily integrated into the athlete’s busy schedule. On average, homework will only take:
10-15 minutes per week for basic reflections or quick drills.
30-45 minutes per week for more involved workout-based homework.
The Importance of Homework:
Homework isn’t just about basketball skills. It’s about building discipline, accountability, and a sense of ownership in the athlete's development. Accountability is crucial to success both on and off the court, and we believe that our homework system helps reinforce this value.
Homework Submission Tracker:
To track each athlete’s engagement, we use a color-coded system:
Green (75% or higher): Athlete has consistently submitted their homework and is doing well in terms of accountability.
Yellow (50%-75%): Athlete has submitted a moderate amount of homework but needs to improve consistency.
Orange (25%-50%): Athlete is underperforming in homework submission and is at risk of falling behind in accountability.
Red (25% or below): Athlete is at a critically low level of homework submission. This is a warning level, and failure to improve may result in a discussion with the parent(s) about possible termination from the program.
12. PROGRAM TERMINATION POLICY
· Athletes who fail to meet the expectations laid out in this agreement, including failing to complete a significant portion of their homework, may be subject to termination from the program. We take this seriously because we believe that accountability is essential for success.
· We understand that athletes are busy with school and other activities, which is why our homework is designed to be manageable. However, failure to complete homework consistently, especially when flagged in the red zone of our tracking system, will trigger a meeting with the parents to discuss the next steps.
